NERC submitted a filing on March 4, 2008 in compliance with the December 20 order where NERC was ordered to address the possible "reliability gap" involving the three Load-Serving Entities Docket No. RC07-4-002, RC07-06-002 and RC07-7-002
Notice of Extension of Time (April 16, 2008)
EEI and NEI requested an extension of time for filing comments on the Commission’s NOPR issued March 20, 2008 regarding the Nuclear Plant Interface Coordination. The Commission granted the extension to May 13, 2008. Docket No. RM08-3-000
The Commission adopts this statement of administrative policy on Commission review of these penalties. In addition, the Commission revises its statement on settlements.
Order Approving Amendment to WECC Business Plan and Budget.
NERC filed a request on February 15, 2008 and March 17, 2008 for approval of an amendment to the 2008 Business Plan and Budget of WECC and for approval for WECC to include loan repayment and interest costs in its 2009 and 2010 assessments.
Notice of Extension of Time (April 17, 2008)
NERC filed a motion for an extension of time to issue a revised registry demonstration for the SEPA as required by the February 21, 2008 Order. FERC granted an extension of time to June 20, 2008. Docket No. RC08-1-000.
Commission proposes to amend its regulations under the FPA to incorporate by reference the latest version of certain business practices concerning the OASIS and four business practice standards relating to reliability issues adopted by the WEQ of NAESB.
Revised Policy Statement on Enforcement.
The Commission issues revised policy statement to the regulated community as to the Commission's enforcement policies concerning the governing statutes, regulations and orders
Commission proposes to approve NERC’s proposed modified interpretation of Reliability Standard BAL-005-0.
Letter Order approving revised VRFs for the FAC standards
The Commission approves the 10 revised VRF assignments for the Facilities Design, Connections and Maintenance (FAC) Reliability Standards approved in Order No. 705. NERC submitted the filing on April 1, 2008 in response to Paragraph 135 of Order No. 705. Docket No. RM07-3-002
Order on Rehearing and Clarification.
The Commission grants ISO/RTO Council's request for clarification and denies the alternative request for rehearing of Order No. 705 and issues Final Rule approving eight Critical Infrastructure Protection (CIP) Standards.
Order on Rehearing.
The Commission grants NERC's request for rehearing of the March 21, 2008 Order and also requires that the Delegation Agreement entered into between NERC and ReliabilityFirst Corporation be revised in a compliance filing
The Commission approves the VSL assignments filed by NERC for the 83 Commission-approved Reliability Standards. The Commission also directs NERC to file modifications to VSLs relevant to five Reliability Standards.
Order Conditionally Accepting Compliance Filing.
The Commission conditionally accepts NERC's compliance filings on April 1, 2008. The filing included a true-up of actual 2007 costs incurred by NERC and the Regional Entities, and responses to other compliance directives in the 2008 Budget Order.
Order on Rehearing and Clarification.
The Commission affirms its basic determinations in Order Nos. 890 and 890-A, granting rehearing and clarification regarding certain revisions to its regulations and the pro forma open-access transmission tariff, or OATT, adopted in Order Nos. 888 and 889 to ensure that transmission services are provided on a basis that is just, reasonable, and not unduly discriminatory. The reforms affirmed in this order are designed to: (1) strengthen the pro forma OATT to ensure that it achieves its original purpose of remedying undue discrimination; (2) provide greater specificity to reduce opportunities for undue discrimination and facilitate the Commission’s enforcement; and (3) increase transparency in the rules applicable to planning and use of the transmission system. Effective September 8, 2008.
Notice of Extension of Time.
NERC filed a motion for an extension of time to submit revisions to the ReliabilityFirst Corporation Delegation Agreement as required by the June 17, 2008 Order on Rehearing. FERC granted an extension of time to July 21, 2008

Guidance Order on Reliability Notices of Penalty.
NERC filed 37 Notices of Penalty on June 4, 5, and 6, 2008. The Commission approved the Notices of Penalty and provided additional guidance that will clarify Commission's expectations regarding the content of future notices of penalty.

Letter Order Accepting FRCC's and NPCC's May 19 Compliance Filing.
The Commission accepted FRCC's and NPCC's May 19, 2008 compliance filing that was in response to paragraph 174 of the Commission's March 21, 2008 Order. The Commission required NERC and NPCC to submit a schedule for ending the technical committee review process described by NPCC in section 3.0 of Exhibit D to its delegation agreement, or a justification for its continuation. The Commission required NERC and FRCC to submit a schedule for ending the stakeholder compliance committee review process or justification for its continuation.
Order on Appeal of ERO Compliance Registry Determination.
The Commission denies the appeal of the U.S. Department of Energy, Portsmouth/Paducah Project. The order remands to NERC for further consideration on the issue whether DOE Portsmouth was properly registered as an LSE and directs NERC to submit a compliance filing within 75 days.
Order Dismissing Request for Clarification.
The Commission issued an order dismissing EEI's request for clarification regarding the Commission's February 21, 2008 Order conditionally approving section 1600 of the NERC Rules of Procedure.
Order on Proposed Clarification.
The Commission issued an order clarifying the scope of the eight Critical Infrastructure Protection Reliability Standards approved in Order No. 706 to assure that no "gap" occurs in the applicability of these Standards.

Order Approving Revisions to Statement of Compliance Registry Criteria V5.0
On July 31, 2008, NERC submitted a response to the Commission's December 20, 2007 Order that directed NERC to address the possible reliability gap that would result if retail power marketers were not registered as LSEs. As part of the short-term solution, NERC submitted revisions to the Statement of Compliance Registry Criteria. Order No. 718 - Ex Parte Contacts and Separation of Functions.
The Commission issued Order No. 718 where it revised its regulations to clarify its rules governing ex parte contacts and separation of functions as they apply to proceedings arising out of investigations initiated under Part 1b of the Commission’s regulations. The revisions specify when Commission litigation staff and persons outside the Commission may contact decisional employees once the Commission has established proceedings on matters that had been investigated under Part 1b.
The Commission directs NERC and the Northeast Power Coordinating Council, Inc. to submit to the Commission a comprehensive list of bulk electric system facilities within the United States portion of the NPCC region. Docket No. RC09-3-000

The Commission accepts NERC's Compliance Filings (July 21, 2008, as supplemented on August 28, 2008 and September 30, 2008) in response to the Commission’s March 21, 2008 order issued in this proceeding. NERC’s compliance filings include revisions to NERC’s pro forma delegation agreement and the individual delegation agreements between NERC and each of the eight Regional Entities. Docket Nos.
